In a divorce, who is the preferred custodial parent – the mother or the father?
Alan R. Nye
Under Maine law, a court can’t favor one parent over the other based upon gender. The law specifically reads as follows:
The court may not apply a preference for one parent over the other in determining parental rights and responsibilities because of the parent's gender or the child's age or gender.
